Aqua Water Supply Corp.’s board approved large-volume water service to Pacifico Energy Development LLC on Sept. 1, advancing the proposed Cedar Creek development toward a formal water service agreement.

The service would support Pacifico’s proposed 2,842-acre data center and power development in Cedar Creek.

What’s happening: In an email to Community Impact, Aqua WSC Communications Director Hollye Fain said the approved resolution indicates Pacifico must pay Aqua WSC a $3,500 legal deposit by Nov. 30 to proceed with development of a Non-Standard Service Agreement.

Why it matters: The NSSA would formalize the terms and responsibilities for providing water service to the development.

Under Aqua’s development process, agreements can address matters including capacity reservations, construction-related costs and infrastructure improvements needed to serve a project.

What’s next: Pacifico has until Feb. 28 to enter into the agreement with Aqua WSC. Fain said missing that deadline could result in the revocation of the approved resolution and feasibility study.

Something to note: Fain said it will be up to the board whether the negotiated agreement returns for further review and approval, adding that she was not aware of the board requesting that step.

Governor Greg Abbott and the Texas Department of Transportation recently announced a 10-year transportation plan that will invest almost $140 billion in roadway improvements across the state. 

The framework: The Texas Transportation Commission approved the 2027 Unified Transportation Program at an August meeting. The funding includes $95 billion for projects across the state and $43 billion for development and routine maintenance. The investment is expected to improve safety, reduce congestion and strengthen the supply chain.

Quote of note: “This 10-year plan reflects the scale and complexity of meeting Texas’ transportation needs in one of the fastest-growing states in the nation,” TxDOT Executive Director Marc Williams said in a news release. “It is focused on practical outcomes—improving safety, preserving the system we have, and supporting reliable movement for people and goods.”

The big picture: The 2027 UTP includes over $1.5 billion for Austin-area projects, including improvements to I-35 in Travis County and SH 71 in Bastrop County.
